Ministry of Commerce Announcement No. 13 of 2026: Announcement of Adjustments to Anti-Discrimination Measures Against Canada

On March 8, 2025, the Ministry of Commerce (hereinafter referred to as the Investigation Authority) issued Announcement No. 11 of 2025, announcing the ruling on the anti-discrimination investigation into Canada’s restrictive measures against China and implementing anti-discrimination measures. Due to recent changes in circumstances, the Investigation Authority has decided to adjust the anti-discrimination measures. The relevant matters are hereby announced as follows:

  1. Investigation of Anti-Discrimination Measures

According to Articles 7, 36, and 37 of the Foreign Trade Law of the People’s Republic of China, on September 26, 2024, the Ministry of Commerce issued Announcement No. 40 of 2024, deciding to conduct an anti-discrimination investigation into Canada’s additional tariffs and other restrictive measures on imports of electric vehicles and steel/aluminum products from China.

On March 8, 2025, the Ministry of Commerce issued Announcement No. 11 of 2025, based on the Foreign Trade Law and the Customs Law of the People’s Republic of China, to take anti-discrimination measures against Canada’s discriminatory tariffs and restrictions on imports of electric vehicles and steel/aluminum products from China, including additional tariffs on certain imports originating from Canada.

  1. Adjustment of Measures

According to Announcement No. 11 of 2025, the anti-discrimination measures may be adjusted, suspended, or canceled in accordance with procedures when any of the following conditions occur: (1) the government of the investigated country/region has adjusted or canceled the measures or practices under investigation; (2) the government of the investigated country/region has provided appropriate compensation for damages caused; (3) the investigated country/region and China have reached a mutually agreed resolution through consultations; (4) the government of the investigated country/region has taken further substantive measures; (5) other appropriate circumstances.

Recently, China and Canada have reached a preliminary joint arrangement on handling trade-related issues. The Canadian government has officially announced some adjustments to its tariffs and restrictions on steel and aluminum imports from China. After verification, the Investigation Authority has determined that conditions (1) and (3) are met and has decided to make corresponding adjustments to the current anti-discrimination measures, removing the additional tariffs on certain imports originating from Canada. The adjustment of tariffs will be announced separately.

  1. This announcement is valid from March 1, 2026, to December 31, 2026.
